You accept that we, Smart River., are not responsible for unauthorized access to your mobile device or app data. By accepting these terms, you agree and undertake that all applications, which you choose to share or suggest sharing may be exposed to unauthorized access, blocking, corruption or wrong usage, and not accepted as %100 secure. You agree and undertake not to try to investigate, scan or test the security gaps or, violate any security or verify identity precautions in any Smart River system. You agree and undertake not to violate any applicable law and regulations. You agree and undertake not to imitate or poorly represent your membership with any individual or organization. Whether or not to translate, combine, adapt, diversify, change or modify all the or one section of the Application or the Services, all other programs, Application or Services, or any part thereof, you agree, declare and undertake that it cannot be merged. You must not send any defamatory, offensive or other objectionable material about our applications or any other use of our Services. You must not use the Application or any Service in any way that could damage, disable, overload, disrupt, compromise or interfere with other users to our systems or securities.

Intellectual Property Rights

Apps and licenses only belong to Smart River. You do not have any intellectual property rights over the apps and the services except for the right to use according to these terms.

Fees and Purchases

Some certain areas of the app and the services can take payment to purchase a subscription from the users to access certain content or certain virtual items. You accept to pay all the fees and the taxes which you paid by you or, any person uses a registered account. The users agree, declare and acknowledge that Smart River. will not be obligated to provide refunds for any reason, and you will not receive any money or compensation for unused content, virtual products or activities when the account is closed whether voluntarily or not.

This kind of purchases is final and non-refundable. If you choose to purchase a seasonal subscription that renews automatically via in-app purchases, your iTunes account will be charged until you cancel it. If you don’t want your subscription to be renewed automatically or change or terminate your subscription, you have to log in to your iTunes account and follow the instructions to terminate your subscription, even if you delete the app or your account. When you delete the app from your mobile device or delete your account, it does not mean that you canceled your subscription. We will keep taking payments from your iTunes account until you cancel your subscription. To get detailed information about canceling your subscription, we will suggest you look Apple Support.

• Our apps are for private use. If users are using the app for marketing, business or resell purposes, they agree and undertake that Smart River. will not be responsible for the possible loss of business, loss of offers or loss of profit.
• Even though we try to update the information that we provide in the apps with reasonable effort, we cannot guarantee, reassure or represent, whether expressing or implying, about its truth, integrity and up to date of the information.
• If our support for the app is delayed by an event beyond our control, we will not be responsible for any problems that may have occurred, but if there is an urgent risk of delay, you can contact us to terminate your contract and get the repayment of the services that you paid but did not receive.
• As Smart River., we suggest you check the apps and the services (as it was explained in App Store’s website) whether they meet your requirement or not.
• As Smart River., we advise you to back up your data and all the content that it was connected the app for the problems that may occur to protect yourself.

Refund Policy

If you are not satisfied with the product that you purchased or that you want to get a refund for any reason, you can look for our Refund Policy to get information about how you can return a product.

Limitation of The Liability

Smart River., partners and license owners will not be responsible for;

• The damage that occur from any indirect, accidental, private, vindictive or risk,
• The profit, income, data, usage, loss of reputation or other losses that are not material,
• The damage to the access to the services, make use of services or not being able to access the services or cannot use the services,
• The damage related to any conduct or content including any defamatory, offensive or illegal behavior without any restriction,
• The damage related to third-party content, third-party product or third-party activity, or
• Liable to you or any third party for damages in any third-party content, third-party product or third-party activity that was accessed through the service.

As Smart River., with respect to individual rights, we respect and care for our users, and we expect the same. We are disconnected from accounts that violate the rights and the rules constantly, or to accounts that violate the rights of copyright holders.
